Lucknow: The proposed by-election on the Swar assembly seat of Uttar Pradesh has been stayed by the top court. Hearing the petition of Abdullah Azam Khan, son of Samajwadi Party (SP) MP Azam Khan, the Supreme Court has stayed the order of Allahabad High Court. SP leader Abdullah Azam was MLA from Swar assembly seat, but last year the court disqualified his membership. After which, recently, the High Court had asked the Election Commission to conduct a by-election in Swar.
However, this decision was challenged by Abdullah in the top court. Abdullah had said in his petition that till the apex court does not give a final verdict on it, it is not right to hold a by-election on his Swar seat. On which now the court has given its verdict. In fact, when the assembly elections were held in Uttar Pradesh in 2017, Abdullah Azam was not 25 years old at the time of nomination, but he contested using fake birth certificate and won and became an MLA.
Bahujan Samaj Party (BSP) leader Nawab Kazim Ali Khan filed a petition against Abdullah Azam. On this petition, the High Court disqualified Abdullah.
