'29-week pregnant woman not allowed to undergo abortion': SC orders AIIMS

New Delhi: Using the privilege, the top court has given a special responsibility to the government and AIIMS on the petition citing the abortion of a 29-week pregnancy by a girl who got pregnant without marriage. Using the special power given under Article 142 of the Constitution for the purpose of complete justice, the AIIMS has been entrusted with the responsibility of safe delivery, health, welfare, and monitoring of the girl child on the basis of top priority.

A bench of Chief Justice (CJI) DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala, on the advice of Solicitor General Tushar Mehta, also ordered that the couple registered with the Central Adoption Resource Authority i.e. CARA for adoption after the birth of the child. The correct pair should be selected in the most appropriate way. 

During the hearing, Additional Solicitor General Aishwarya Bhati made an emotional appeal to the court saying that she is ready to adopt the child. She will keep him at her residence. After this, CJI Chandrachud called all the parties in his chamber in view of the seriousness of the matter and held discussions. After this, the court issued the order using the privilege given under Article 142.
