Allahabad HC:
Allahabad HC: "Can't buy land without paying compensation"
Share:

Prayagraj:  The  Allahabad High Court said, the state is not allowed to take people's land without compensating them. In this case, the court has requested personal affidavits from the Additional Chief Secretaries of the concerned departments in Uttar Pradesh.

A division bench comprising of Chief Justice Rajesh Bindal and Justice Piyush Agrawal will hear the petitions filed by Jeet Narain Yadav and two others on December 3. All three petitioners claimed that their land had been taken from them without compensation.

The court took the submission seriously and noted that it regularly hears cases in which land has been acquired and possession has been taken but no compensation has been paid, or cases in which possession has been taken without land acquisition and compensation has been paid.

The court then directed the additional chief secretaries of the three departments to prepare a list of such cases pending in this court, along with the issues raised therein, after it was pointed out that land is mostly acquired by the revenue department, public works department, or irrigation department.
