Prayagraj: Allahabad High Court has quashed all the notifications issued regarding the inclusion of 18 OBC castes in the scheduled category in Uttar Pradesh. Giving information about the order, the counsel for the petitioner, Rakesh Gupta, said that the court had already stayed the implementation of all these notifications. Akhilesh Yadav and Yogi Sarkar had issued two notifications each during their tenure and recommended the inclusion of 18 OBC castes in the scheduled category in the state.
It is noteworthy that earlier in the year 2005, the then Mulayam Singh Yadav government had also decided to include one and a half dozen OBC castes in the list of SC. The High Court had stayed that too. Let us tell you that the OBC castes which were notified to be included in the SC include Majhwar, Kahar, Kashyap, Kewat, Mallah, Nishad, Kumhar, Prajapati, Dhivar, Bind, Bhar, Rajbhar, Dhiman, Batham, Turha, Godia, Manjhi and fisherman castes.
The court has also made sharp remarks about the functioning of the governments in its order. The court said that despite not having a constitutional right, the list of Scheduled Castes was being amended repeatedly for political gains in UP. The court said that only the Parliament of the country has the right to amend the list of Scheduled Castes under Article 341 of the Constitution. The Constitution has not given any right to amend this list to the Central and State Governments.
