Lucknow: The Allahabad High Court has given an important verdict in the case of a man who did two marriages. The High Court, while hearing this matter on Monday (10 October 2022), said that 'According to the Quran, a Muslim man can do second marriage only if he is able to take care of his first wife and children. If he is unable to maintain them, then he has no right to do another marriage.'

The Allahabad High Court, citing Surah 4 Ayat 3 (Qur'an) has said, 'Second marriage can be done only when the husband is able to raise his first wife and the children born to her. This applies to all Muslim men.' After this, the High Court dismissed the petition of the husband Azizur Rahman. A bench of Justice Surya Prakash Kesarwani and Justice Rajendra Kumar has observed that 'A society in which women are not respected, cannot be called civilized society. Only a country that respects women can be called a civilized country. Muslims themselves should refrain from having a second marriage with the first wife. The Quran also does not allow a second marriage to a Muslim man who is unable to take care of his first wife.'

The two-judge bench further said that under Article 21 of the Constitution, every citizen has the fundamental right to live a life of dignity and personal liberty. Article 14 provides the right to equality to all and Article 15(2) prohibits discrimination on the basis of gender etc. According to media reports, Azizur Rahman and Hamidunnisha were married on 12 May 1999.

The wife is the only child of her father, due to which her father has donated all her property to him. The woman takes care of 93-year-old Abba along with her three children. Her husband did another marriage without informing her and she has children too. The husband had filed a case in the family court to keep the second wife with him. When the verdict did not come in favour of Azizur Rahman, he filed an appeal to the Allahabad High Court, which was dismissed by the High Court.
