New Delhi: A march from Mandi House to Parliament is being taken out in protest against the decision of the top court on reservation in promotion. This March is being led by Bhim Army Chief Chandrashekhar Azad. It is noteworthy that the Uttarakhand government had filed a petition in the Supreme Court against reservation in promotion, which was accepted by the court and decided to remove reservation from promotion. Ever since the decision of the Supreme Court, Dalit organizations have been protesting all over the country.

Gyan Chand, a resident of Udhamsingh Nagar, posted as assistant commissioner in the tax department in Uttarakhand, approached the High Court against a notification from the Uttarakhand government, in which the state government had issued a notification that there would be no reservation in promotion. The state government had cited Articles 16 (4) and 16 (4-A) for this. The Uttarakhand High Court rejected the plea of the state government and ordered reservation in promotion, after which the state government chose it in the top court in 2019.

The Uttarakhand government argued in the apex court that there are no proposals to this effect in Articles 16 (4) and 16 (4-A) of the Constitution and reservation is not a fundamental right of anyone. On 7 February 2020, the apex court accepted the contention of the Uttarakhand government that these two articles of the Constitution give the government the right to believe that if the SC-ST community does not have adequate representation in government jobs, it will give jobs and Law can be given to give reservation in promotion.
