High court to Maharashtra government says, 'Preventing elderly artists from going out and working is discrimination'

Mumbai: The Bombay High Court has questioned the Maharashtra government that if the state is not stopping a senior citizen from opening its shop and sitting in the shop all day. Then on what basis is he preventing artists over the age of 65 from going to work during the current lockdown.

A bench of Justices SJ Kathavala and Justice RI Chagla said that the state's decision to stop physically healthy, over 65-year-old actors from shooting and going out for such works would have seemed a case of 'discrimination'. The bench has directed the state government to file an affidavit clarifying on what basis such a ban has been imposed. The bench also said that the state has to clear whether it has taken into account any kind of 'data, statistics or report' for issuing such prohibitory orders.

The court was hearing a petition filed on behalf of 70-year-old Pramod Pandey, challenging the guidelines issued by the Maharashtra government on May 30, 2020. These guidelines state that no cast or camera crew over the age of 65 will be allowed to appear on film or TV sets during shooting. In a petition filed through advocate Ashok Sarogi, Pandey said that he has been playing small roles in TV serials and films for four decades and has no other source of income.
