Patna: The CBI has challenged in the Supreme Court the bail granted to Rashtriya Janata Dal (RJD) supremo and convicted in fodder scam case, Lalu Prasad Yadav, in two fodder scam cases. The CBI has challenged the Jharkhand High Court's order in the apex court while filing an SLP allowing the release of Lalu Prasad Yadav on bail.
Hearing the CBI's plea, the Supreme Court has issued a notice to former CM Lalu Yadav. The case will now come up for hearing after 4 weeks. Lalu has been ordered to be released on bail by the Jharkhand High Court in the Dumka and Chaibasa treasury cases, but due to his conviction in another fodder scam case, Lalu is still in jail. In this case, the CBI has moved to the Supreme Court through the Jharkhand government. This is a legal whammy because the CBI has investigated the scam and punished Lalu and the other accused. But the convicts serving the sentence are in the judicial custody of the Jharkhand government i.e. in jail. Therefore, the Jharkhand Government is also a party to it.
During the arguments, the CBI, through the Jharkhand government, has said that the basis of the bail order granted to Lalu is wrong as the culprit Lalu Yadav has not spent the required time in jail. The CBI has told the Supreme Court that the Jharkhand High Court while granting Lalu Prasad Yadav's bail plea, had given its verdict that Lalu Yadav has already served half of the sentence, but this is not true.
