Center urges SC collegium to reconsider recommendation on KM Joseph

NEW DELHI: The government on Thursday asked to the Supreme Court collegiums for recommendation to elevate Justice KM Joseph to the top court and urged it to reconsider about him.

In this bid, Law minister Ravi Shankar Prasad wrote to Chief Justice of India Dipak Misra this morning urging the collegiums means a group of five senior-most judges that selects judges for the top court, to reconsider its pronouncement on recommending Justice Joseph to be a judge of the apex court.

The development comes a day after when the government cleared the appointment of senior advocate Indu Malhotra as a judge of the Supreme Court and kept in side for a decision on Joseph. Joseph heads the Uttarakhand High Court. Both the names were recommended by the collegium earlier this year.

In a ruling in 2016, Justice Joseph had cancelled President's rule in Uttarakhand and brought back the Congress government of Harish Rawat to power. The judgment was seen as major setback to the Modi-led- BJP-ruled government at the Centre.

The government's pronouncement of not approving Joseph's name has induced sharp reactions with the Supreme Court Bar Association

Earlier today, Rahul Gandhi –led-Congress accused Prime Minister Narendra Modi of indulging in "revenge politics" by "refusing" to clear the elevation of the nation’s senior-most chief justice, KM Joseph, to the top Court.

The judiciary is under the "most vicious attack ever" and dictatorship will stub democracy if the nation does not wake up now, Congress communications in-charge Randeep Surjewala made allegations.
