Centre issues show-cause notice to Alapan Bandyopadhyay, may be jailed for years

New Delhi: Former West Bengal Chief Secretary Alpan Bandyopadhyay who retired a day earlier, has different opinions from legal experts on the Centre's issuance of show cause notices. Some experts claim that the move is not going to last, while others said action could be initiated against Alpan Bandyopadhyay for violation of service rules.

The Union Home Ministry has sent a show cause notice to Bandyopadhyay under a stringent provision of the Disaster Management Act amid clashes between the Centre and the Mamata Banerjee government. Under this provision, imprisonment up to two years can be inplace. Senior advocate Vikas Ranjan Bhattacharya says that "show cause notice is not going to stand the legal test. The CPIM leader, who served as the Advocate General of Tripura, said, "The absence of a meeting is not in violation of the directions issued under the Disaster Management Act in any way, so the show cause notice issued is not going to stand the legal test.

Advocate Loknath Chatterjee said that as per the provisions of the Disaster Management Act, action can be taken against the person who does not take action. He said, "This is a violation of their service rules and disaster management law. Alapan did not attend the meeting even after a senior authority asked him to do so. Another lawyer Jayant Narayan Chatterjee said that there is no provision under Section 51-B of the Disaster Management Act to send show cause notices.
