Indore: A new controversy has emerged regarding the name of Congress MLA Jitu Patwari from Rau in Madhya Pradesh. In fact, the Congress leader had written his name as Mahesh alias Jitendra Patwari in the joint loan of Rs 8.25 crore for the warehouse from Naulakha branch of Bank of Baroda (BoB). Whereas, in the nomination paper filed during the 2018 assembly elections, his name is registered as Jitendra. However, this loan must be mentioned in the nomination. They haven't been able to repay about two crores of the loan. After which the court has issued orders to attach the mortgaged property for the warehouse and loan.

According to the report, a combined loan of 8 crore 15 lakh was taken in three installments between 2014 and 15 from Bank of Baroda's Naulakha branch for a warehouse in Alwasa village under Hatod tehsil of Indore. This loan is in the name of Lakshya Warehouse & Partners. Its partners are the names of Mahesh alias Jitendra father Rameshchandra Patwari, Bharat Patwari, Rajneesh Patwari and Kulbhushan Patwari. These people have also been made guarantors in the loan. About 2 crore 21 lakh 69 thousand is outstanding of the loan. Putting September 2022 in Non Performing Asset (NPA), the bank had given notice to pay the amount in 60 days on 11 October 22.

The bank filed an application in the court to get possession of the property for not paying the amount. On March 2, 2023, Chief Judicial Magistrate Lokendra Singh has issued orders to the bank to attach the property mortgaged for the loan by the guarantors. Bank manager Rishi Talwar says that the court order has just arrived. Action to take physical possession of the property will be done as per rules. 

What do the rules of the bank say: -

Explain that according to banking rules, the borrower and the guarantor cannot be the same person. If a person does this, then action can be taken against him under sections 420 and 120B. On the other hand, if another property equal to the loan amount is mortgaged, then in some cases the bank may give exemption to make it a guarantor. But, usually this is not done, because if the borrower drowns, then the recovery of the bank is not possible.

What did Jeetu Patwari say: -

Congress MLA Jitu Patwari has to say on this matter that the name of my house is Mahesh. The land on which this warehouse is situated, jointly owned by the family, had my house name registered as Mahesh. That's why Mahesh alias Jitendra was written there (at the time of loan). Later, I have also completed the process of name change. The loan was of 8.25 crores and only one crore was left, which became about 2 crores including interest etc. The land is mortgaged, its value is 100 crores. Due to the policies of the government, all the warehouses built by the farmers on subsidy have become defaulters. The government is not keeping wheat in them at all. He said on the loan that he will soon repay the rest of the loan as well.
