New Delhi: The Delhi High Court on Wednesday stayed the Centre's order to transfer electricity generated from Dadri Thermal Station from the country's capital to Haryana. A bench of Justice Yashwant Verma issued notice on a petition by BSES Rajdhani Power Limited challenging the March 29 order of the Ministry of Power regarding the transfer of power supply from the Dadri-II plant to another state and issued notice to the counsel for the Central Government. Time is given for instructions.

The petitioner claimed that the order was completely out of the jurisdiction and if implemented, 23 per cent of Delhi's population would be deprived of electricity in the next 24 hours. The court has ordered that the matter will now be heard on April 1, till then the impugned order dated March 29, 2022, will continue to stay. The court is also taking note of the presumptions made in paragraph 5 of the writ petition, where the petitioners claim that the application, if allowed to be enforced, would come into force from 12 noon on Friday, April 1, 2022.

The court said that if the impugned order will come into force from 10:00 am on Thursday, March 31, 2022, there will be a power shortage in Delhi, so electricity will have to be arranged before it is implemented. While this matter needs to be considered. The petitioner has contended that the respondent authorities have no right to reallocate the power, which is part of the allotment made in favour of the petitioner and is duly approved by the Delhi Electricity Regulatory Commission.
