Supreme Court in unanimous decision decriminalises Section377, sex with animals and children will be criminalized

New Delhi: Five-judge of Supreme Court bench by unanimous decision decriminalised Section 377 as saying LGBT Community has same rights as of any ordinary citizen. However, Supreme Court said other aspects of Section 377 dealing with unnatural sex with animals and children remain in force.

This section of the IPC put gay sex in the category of crime. The bench of Chief Justice Deepak Mishra, while hearing the case, has removed gay sex from the category of crime. The court has said that making physical relations comes under the protection of privacy and it is the fundamental right of the citizens.

During the hearing on the batch of petitions of Section 377 in Supreme Court, "LGBT Community has same rights as of any ordinary citizen. Respect for each others rights, and others are supreme humanity. Criminalising gay sex is irrational and indefensible", observed CJI Dipak Misra.

" Sustenance of identity is the pyramid of life",  Chief Justice of India Dipak Misra added.

In July 2013, in an earlier round of court case, the top court had reserved the verdict of the Delhi High Court decriminalizing unnatural sex relationship or homosexuality. On July 17, the apex court had said that it was duty bound to nullify a law that is in disagreement the fundamental rights.
