Guwahati High Court slams Assam government over Detention Center in Jail Campus

Guwahati: The Guwahati High Court has said that people declared foreigners cannot be kept in jails. The court said that such citizens cannot be imprisoned in jail in the name of detention camps. Placing them in the Detention Center located in the prison premises deprives them of their basic human rights and human dignity.

The court has also directed the Assam government to file a report regarding the steps taken for the detention center built outside the jail premises. The court has also asked the state government to tell that if it does not have a suitable place, then it should rent the private premises and inform the court about it. The Guwahati High Court has lambasted the Assam government for operating six detention centers for illegal foreigners inside the jail premises. The court has asked for an action report to be submitted within 10 days about hiring suitable accommodation for this.

Justice Achintya Malla Bujor Barua also rejected the state government's plea to comply with the 2018 directive of the Union Home Ministry to declare a part of the jail premises as a detention center. According to the media report, the court while hearing several petitions filed in this regard on Wednesday said that even the guidelines issued for detention centers stated that the detentions would be set up outside the central jail complex. If suitable accommodation is not provided, then the state government can rent private buildings.
