Chandigarh: While giving an important verdict, The Punjab-Haryana High Court has made it clear that if someone's spouse is suffering from HIV then he can or she can get divorce.
The husband had filed a petition for divorce in the family court, stating that he was married in 2016 and that his wife's behavior after marriage was very bad for him and his family.

A few days after the wedding, she left her mother-in-law with all her belongings and left. She was brought back and during this time she became pregnant. During the investigation, it was revealed that he is HIV positive. To this, the wife said that during pregnancy, her sisters, who are medical students, injected her with the same needle three times a day to gain weight. The wife said that she was not HIV positive before marriage and that she has got HIV due to the injection. Rejecting this argument, it was told in the investigation report that repeated injections with the same needle does not cause HIV, it happened due to some reason.

The family court granted the divorce petition of the husband and ordered the divorce between the two. Challenging this decision, the wife has filed a petition in the High Court. Hearing the wife's petition, the High Court said that the wife has HIV and the husband does not have HIV. This disease spreads through bonding and in such a situation it can happen to husband. For this reason, the husband can apply for divorce on the basis of HIV. At the same time, the High Court has rejected the appeal filed against the wife's order of the family court, while stamping the order of the family court.
