At that time, the court had made it clear that Kalyan Singh could not be prosecuted because of the defense provided by the constitution to the governors. According to Article 361, the President and Governors are exempted from lawsuits while in office. Due to this, Singh was then relieved. According to sources, if Kalyan Singh no longer holds the post, he can be prosecuted. However, if the government reappoints him to another constitutional post, he can survive.
