Kerala Orthodox church approaches High court against govt act on burial of Jacobites

Kerala-Kochi: The Orthodox church has moved a plea in the High Court against the state government which is likely to strengthen the dispute with Jacobites over church ownership. In the plea, the Orthodox church questioned the government for passing an Act that allowed the burial of Jacobites in the cemeteries of churches under the control of the Orthodox. A bench of Justice PV Asha served a notice to the state government and parties in the case.

The move of the Orthodox church will get more significance in poll-bound Kerala.

The High Court will consider the petition on February 17. In 2020, the state government brought an ordinance permitting the burial of Jacobites in their family cemetery which is now under the control of the Orthodox. Now, the Orthodox church has approached the HC claiming the move was anti-constitutional. 

Later, the government passed this ordinance as the Kerala Christian Cemeteries (Right to Burial of Corpse) Act.

The Kerala right to burial of corpse in Christian (Malankara orthodox-Jacobite) cemeteries act, 2020 is an act to provide for the burial of corpse and funeral services of Christians belonging to Malankara orthodox-Jacobite denominations and for matters connected therewith.
