Legal Precedent: Woman Not Liable for Boyfriend's Suicide, States Chhattisgarh High Court

Raipur: In a ruling on December 7, 2023, the Chhattisgarh High Court declared that a woman cannot be held responsible for her boyfriend's suicide following the failure of their love relationship. The court dismissed the case of abetment to suicide filed against a 24-year-old woman and her brother in the matter.

The case, heard by Justice Partha Pritam Sahu, originated in Rajnandgaon. On January 23, 2023, a young man took his own life, leaving behind a suicide note. The note detailed his eight-year-long love affair with a girl who ultimately broke ties with him to marry another man, allegedly influenced by her brothers.

The suicide note accused the girl's two brothers of pressuring her to end the relationship and also claimed that they had taken money from the deceased without returning it. The Rajnandgaon police registered a case under sections 306 and 34 of the IPC, leading to the arrest of the three accused. On October 13, 2023, the district court framed charges against the girl and her brothers.

After the charges were framed, the accused challenged the case in the Chhattisgarh High Court. Justice Partha Pritam Sahu, after the hearing, stated that there was no concrete evidence to prosecute the accused based on prima facie considerations. He emphasized that relying on hearsay and word of mouth is insufficient grounds to proceed with the case.

The prosecution argued in the High Court that the accused had issued threats to the deceased, including implicating him in false cases and facing severe consequences. However, Justice Partha Pritam Sahu asserted that none of the threats appeared serious enough to drive someone to commit suicide.

The High Court, in its order, stated, "If someone commits suicide due to a failed love affair or examination, the woman or the examiner cannot be held responsible. Similarly, if someone commits suicide after losing a legal case, the lawyer cannot be blamed for abetting the suicide. The individual's misguided decision cannot be attributed to someone else instigating them."
