Live-in Relationships Still Taboo in Indian Society: Chhattisgarh High Court Rules

In a recent ruling, the Chhattisgarh High Court refused custody to Abdul Hameed Siddiqui for a child born from his live-in relationship with Kavita Gupta, shedding light on the complexities of interfaith marriages and the burden of proof required.

RAIPUR: The Chhattisgarh High Court has declined a man’s request for custody of a child born out of a live-in relationship, citing the intricate nature of personal laws and the challenges posed by interfaith unions.

A bench comprising Justice Goutam Bhaduri and Justice Sanjay S Agrawal remarked that the concept of live-in relationships "remains stigmatized in Indian society, conflicting with traditional beliefs."

"The idea is foreign to our cultural norms," the court stated, underscoring that the rules of personal law cannot be enforced in any court without being substantiated as customary practices.

Abdul Hameed Siddiqui, a 43-year-old resident of Dantewada, had petitioned for custody of the child born from his live-in arrangement with 36-year-old Kavita Gupta. After his plea was rejected by a family court in Dantewada in December 2023, Siddiqui sought recourse from the High Court.
