MP High Court pronounces this verdict on the right to withdraw the bail under Atrocities Act

Gwalior: A single bench of the Madhya Pradesh High Court has given a significant verdict in the case filed under the Atrocities and Poxo Act. Recently, the court said that if anyone violates the conditions imposed, then he has the right to withdraw the bail under the Atrocities (SCST) Act. Apart from this, the court has also issued an order that the trials of those accused under the Atrocities Act and POCSO, should be transferred to the special court which has been made for hearing the POCSO Act. At the same time, the petition in which the court has given this decision has not withdrawn the bail of the accused.

It is being told that the High Court had heard about whether the bail can be withdrawn under the Atrocities Act. In fact, in the past, the mother of a minor had filed a petition in the High Court. In that petition, the mother argued that the accused has been released on bail by the court. Three conditions were imposed for release on bail. In this, instructions were given to remove the accused from the minor, but after escaping from jail he ran away with the minor. This petition stated that the accused has violated the condition of bail and now his bail should be revoked. At the same time, advocate Gaurav Mishra, on behalf of the accused in this case, argued that 'the court has the right to grant bail in the cases registered under the Atrocities Act, but it does not have the right to withdraw.' In fact, it has been said that this bail is granted under the Criminal Appeal.

Indeed, the High Court appointed senior lawyers as amicus curiae to determine this point of law. During this time, the judges gave their opinion about the law. After that the High Court had reserved its decision. Now the court has given its verdict on Thursday. It is being told that the bail of the accused has not been withdrawn, but after exercising his rights, he has is allowed to withdraw the bail.
