Mentally challenged rape victim allowed to have abortion: Kerala High Court decides

Kochi: The Kerala High Court on Tuesday, playing the role of a legal defender of parents or citizens, allowed the pregnancy of a mentally challenged rape victim to be demolished for more than 15 weeks. The court said the victim is unable to take a decision on her own and that is a good decision for her. The High Court has allowed the Government Mental Health Centre and Sri Avittom Thirunal Hospital in Thiruvananthapuram to undergo an abortion.

The court also directed these hospitals to take the embryo tissue and maintain it for DNN examination. Because this mentally challenged woman is a rape victim. Justice PB Suresh Kumar has taken the decision on the basis of a medical board report. Who, after examining the woman, said that though continuing the pregnancy does not pose any threat to the life of the rape victim, the mentally challenged rape victim is undergoing medicine. Which can be dangerous for both. A certificate issued by the Medical Board also indicated that the victim was unable to make a decision or give her opinion.

The judge said, 'Considering the fact that the woman involved in the case is a rape victim and considering the opinion of the Medical Board, I think it is in the best interest of the person concerned to end a pregnancy in such a case.'
