Minor Rape Victim's Identity Disclosure By Rahul Gandhi Against Law: NCPCR

The National Commission for Protection of Child Rights (NCPCR) brought attention to Congress leader Rahul Gandhi's social media posts, which allegedly revealed the identity of a minor Dalit girl who was raped and killed in 2021. The NCPCR informed the Delhi High Court that such actions were in direct violation of the law that safeguards the identity of victims.

During the court proceedings, the child rights body submitted an affidavit in response to a petition seeking the registration of an FIR against Gandhi. The petition claimed that the politician had shared a photograph on his social media accounts, showing him meeting the parents of the victim, thereby leading to her identification. The NCPCR asserted that this act is explicitly prohibited by the Juvenile Justice Act, 2015, which prohibits the publication of any information, including family details, that could lead to the identification of a minor victim.

Apart from the Juvenile Justice Act, both the Protection of Children from Sexual Offences Act and the Indian Penal Code also consider disclosing the identity of a minor victim as a punishable offense, as highlighted by the NCPCR.

The court had previously sought the response of the NCPCR on a petition filed by a social activist, Makarand Suresh Mhadlekar, who sought an FIR against Gandhi for the alleged revelation of the minor Dalit victim's identity through a photograph with her parents on Twitter. The incident had occurred in 2021 when a nine-year-old Dalit girl died under suspicious circumstances in southwest Delhi's Old Nangal village. Her parents had accused a crematorium priest of raping, murdering, and cremating her.

Regarding Twitter's involvement, the micro-blogging website stated that the tweet in question had been "geo-blocked" and was unavailable in India. Initially, Gandhi's entire account had been suspended, but it was later restored.

Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula's bench listed the petition for further hearing on November 23.

In light of the seriousness of the offense committed by the Congress politician, NCPCR asserted in its affidavit that it had forwarded the complaint to the Delhi Police and Twitter. The aim was to ensure the removal of the offending post and to take necessary action against Gandhi's Twitter handle.
