Minor son wants to donate his liver to ailing father, will SC allow him?

New Delhi: minor boy (17-year-old) wants to donate his liver to a critically ill father. However, the existing law is becoming an obstacle in this. The apex court is scheduled to hear the matter today. The question is, can the court allow a minor child to donate organs? The child's lawyer claims that donating the liver can save the father's life.  

Earlier, the apex court had on Friday sought a response from the UP government on the petition regarding the matter. The matter came up before a bench headed by Chief Justice UU Lalit, which has sent notice to the state government considering its extreme need. The minor's counsel told the court that his father was in a critical condition and his life could be saved only by donating organ.

The court hearing the case also includes Justices SR Bhat and PS Narasimha. He has said in his previous order, "The petitioner (son) is trying to donate liver to his critically ill father. However, under the law related to this issue, the organ donor should be an adult. The court then said that the notice should be replied to by September 12.''

What the law says:-

Existing Indian laws do not allow a minor to donate organs before death. According to the government's Transplantation of Human Organ and Tissue Rules 2014, a minor is prohibited from donating a living organ or tissue. However, it also provides that organ donation can be done if proper reasons are given. Earlier, a similar case had come up before the Bombay High Court. A 16-year-old girl had requested a portion of her liver to be donated to her ailing father.
