The intermediary guidelines issued by the Department of Information Technology seem to be getting the consent of social media companies. In fact, GOOGLE, FACEBOOK and WHATSAPP have shared details with the IT department under the new social media rules.

The Ministry has sought information from social media platforms. Some of which come under the definition of 'important social media intermediary'( SSMI) under the IT Act and new rules. In order to ensure compliance of these rules, provide physical address of platform in India along with details like name of social media platforms app, website and services along with details of 3 key personnel. The letter says that if you are not considered SSMI, the registered consumer data on each service should be given because of this.

Social media companies seem to be losing their intermediary unit status if they do not comply with the rules. In other words, they can be criminally investigated in case of compliance. As per the new rules, if any material is objected to by the authorities and asked to be removed, they will have to take steps within 36 hours.
