New Delhi: After triple talaq, the issue related to divorce has once again reached the door of the law. A petition has reportedly been filed in the apex court to declare as unconstitutional the methods of 'unilateral' divorce outside the judicial purview, including Talaq-e-Kinaya and Talaq-e-Bain. The petitioner says that it has been banned in many Islamic nations, but continues in India.

A petition has been filed in the Supreme Court on behalf of Dr Syeda Amreen, who was subjected to physical and mental torture by her husband and in-laws. In her petition, she emphasised that such practices are not only against the dignity of the woman but also violate the fundamental rights guaranteed in Articles 14, 15, 21, and 25 of the Constitution.

According to media reports, Talaq-e-Kinaya/Talaq-e-Bain is given through the words Kinaya. This means I'm freeing you, now you are free, this relationship is haram, you can separate from me now, etc. The petition filed in the Supreme Court said that Talaq-e-Kinaya and Talaq-e-Bain and other unilateral methods of divorce outside the judicial purview do not match the modern principles of human rights and gender equality.
