Srinagar: Till now we had heard that terrorist does not have any religion or belief, but now on the death of terrorists, the right to offer prayers has been sought for them and interestingly, the High Court has given permission while hearing for this. In fact, the Jammu and Kashmir High Court has given a big decision regarding the offering of Namaz during the last rites of the terrorists killed in the military operation, which can create another dispute. 

The High Court has said that offering prayers to the slain terrorists are not an 'anti-national' activity. The Court also referred to the Constitution for this and said that it is not an activity to deprive them of their personal liberty, as provided for under Article 21 of the Constitution of India. A Bench of Justice Ali Mohammad Magrey and Justice MD Akram Choudhary in the Jammu and Kashmir High Court, filed by the Government against the orders passed by Special Judge Anantnag (Designated Court for Unlawful Activities (Prevention) Act) on February 11, 2022 and February 26, 2022, Hearing on two petitions completed. 

Let us inform you that in November 2021, a local terrorist of the terrorist organization Hizbul Mujahideen was killed during an encounter with security forces. A case was registered against some villagers of Devsar, Kulgam, including Imam of Masjid Sharif, and Javid Ahmed Shah, for the prayers offered by local Muslims during the funeral of this terrorist. However, these people got bail from the lower court. Now the Jammu and Kashmir High Court upholding the bail order given by the Lower Court said that no person can be deprived of his fundamental rights under Article 21 of the Constitution of India. 

The court further said that offering Namaz at the last rites of the slain terrorist is not an anti-national activity. Along with this, the court, while retaining the bail of the accused, rejected the government's plea and said that during the investigation of the case, nothing objectionable was found against the accused respondents, so that they should not be granted bail. The court observed that the lower court had rightly granted bail to the defendants. However, a big question is arising from this decision of the court if prayers are being offered by people in this way for a terrorist who is anti-India. During that time, even if 2-4 people became terrorists by being sympathetic or inspired by terrorists, then will there not be a danger to the people of the country?
