Saint Keshavanand Bharti passes way, had fought in Supreme Court for 'Fundamental Rights'

New Delhi: Petitioner Sant Keshavanand Bharti, who filed a petition in the apex court to keep the basic structure of the Constitution intact, has died this morning. He was a resident of Kasagod district in Kerala. He died in his ashram built there. He was 79 years old. Explain that Keshavanand Bharti had filed the apex court petition to challenge the land reform laws brought by the state government to distribute land to the landless farmers of Kerala.

The petition of Sant Kesavanand challenged the 29th Constitution Amendment relating to the inclusion of Kerala Land Reform Act 1963 in the Ninth Schedule of the Constitution. Kesavanand called this law a violation of fundamental rights and demanded a ban on it. The apex court had constituted a 13-member constitution bench to hear the matter. Who had heard the case for 68 days. It was during this hearing that the 'Infrastructure Theory' came out. Eminent lawyer Nani Palkiwala argued on behalf of Keshavanand Bharti.

In this famous case, on 24 April 1973, the apex court ruled on the basis of a majority of 7: 6. However, Kesavanand Bharti did not get personal relief in the case. But this led to an important constitutional principle under which the Parliament's rights to amendment could be limited.
