Supreme Court says this on the investigation of the murder of BJP MLA

The Supreme Court of India refused to stay the NIA probe initiated in the murder of BJP MLA from Chhattisgarh. BJP MLA Bhima Mandvi and four security personnel from Dantewada were killed by Naxalites last year. However, the apex court said that the action of the National Investigation Agency (NIA) would come under the purview of the result of the petition filed before it by the Chhattisgarh government.

For your information, let us tell you that the Chhattisgarh government had sought to declare the NIA action unconstitutional and arbitrary and alleged that it affects the sovereignty of the state. The state government has challenged last year's order of the High Court. In this, the court rejected the state government's appeal against an earlier order to hand over the murder of Mandvi and four security personnel to the NIA.

On the other hand, the state government had challenged the Centre's notification of 16 May 2019 regarding the direction of handing over the murder investigation to the NIA. A bench of Justices AM Khanwilkar and Justice Dinesh Maheshwari said, "Of course it is in the notified offenses and NIA can investigate it as per the notification of 16 May 2019". The bench said, 'We do not want to interfere with the investigation initiated by the National Investigation Agency. Now the investigation must have gone ahead.
