Supreme court dismisses plea of office assistants of Tamil Nadu courts

The Supreme Court has recently rejected leave petitions. This is the same petition which was filed in various courts in the Erode district of Tamil Nadu state by persons working as office assistants/record clerks claiming promotion to the post of Junior Belief. Writ petitions were filed by 22 persons. 3 of these records are working as clerks. The rest are working as office assistants in various courts of Erode district.

His petitions were rejected by the High Court of Madras. He did not insist on the educational qualification passed in SSLC. But demand was issued to consider his claim for promotion to the post of the junior bailiff. The High Court has rejected the claim on the ground that in the previous decision of the group of 22.7.2009 cases of the court which had a very high dependency. According to the information received, after the enactment of the Tamil Nadu Government Employees (Conditions of Service) Act, 2016 is no longer of any relevance and the date on which vacancies have come out, cannot determine the rules applicable for recruitment by promotion.

On the other hand, the Supreme Court bench of Chief Justice SA Bobde, Justice AS Bopanna, and Justice V Ramasubramanian investigated the matter. In the investigation, he observed that after the implementation of the recommendations of the Shetty Commission and (ii) Tamil Nadu Pay Commission, no one is entitled to claim the right of promotion to the post of the junior bailiff, without the prescribed qualifications. It further states, "the rationale surrounding the Tamil Nadu Government Employees (Conditions of Service) Act, 2016, and the fact that the vacancies arose in the year 2015 prior to enactment, are of no relevance. The Act is intended to recruit and the conditions and rules of service of persons appointed for subordinate services in the State of Tamil Nadu were made to strengthen the relevant law in accordance with the mandate contained in Article 309. Until the coming of this Act, the State of Tamil Nadu, like many States, only Section 309 Were issuing rules in the exercise of the power conferred by it, although such rules were meant only to make arrangements for bridging the gaps until the Act was enacted by the legislature. "
