New Delhi: Taking a final view on the control of the Services department in Delhi the Central government has stated that it is against the law as the matter is still pending in the
Top Court.

The Centre’s statements came just hours after Delhi Chief Minister Arvind Kejriwal claimed in a press conference on Friday that the Centre and Lt Governor Anil Baijal were violating the Supreme court’s rule by their negative response to give control of the Services department to the AAP-led Delhi state government.

Baijal, on his part, has also drawn attention and said that the control of the Services department would remain in his hands until the Supreme Court’s regular bench orders on the Ministry of Home Affairs (MHA) notification from 2015 which authorized the LG to take a final call on postings and transfers of bureaucrats in Delhi.

In a statement the MHA stated that it had not “advised L-G to ignore any part of SC order”, and that Kejriwal's statements were “misleading". The MHA “has only advised the L-G, based on a reference received from him, to follow the law,” the MHA talking head was quoted by The Indian Express as saying.
