Mumbai: The Bombay High Court on Tuesday said that for the healthy development of every child, it is necessary to have the company of not only its parents but also its siblings. A division bench of Justice Ramesh Dhanuka and Justice Gauri Godse said that it was an unfortunate matter where a 15-year-old child refused to meet his father on the basis of his past experience. However, the child expressed his desire to meet his elder siblings.

Expressing grave concern over children being used as 'slaves' or movable property in matrimonial disputes, the Bombay High Court on Tuesday directed a woman to come to India from Thailand with her 15-year-old son, so that he could be with his father and family. The bench said that the welfare of the child was more important than the rights of parents over a child.

The court was hearing a plea by a man who has sought permission to visit his 15-year-old son, who lives with his mother in Thailand. The court noted that the boy is deeply shocked by the bitter litigation between his parents and is keen to meet his father. The bench said, "Children cannot be treated as slaves or property where parents have absolute authority over the fate and lives of their children. The welfare of the child is paramount, not the legal rights of the parents." " The estranged husband and wife have two adult children: a son and a daughter. Both of them live with their father. The petition requested the court direct the woman to bring her son to India during the summer vacations. Give. The bench directed the woman to come to India with her son, so that he can meet his father and elder siblings. The court said that the father shall not file any complaint or take any action regarding the arrest or detention of the woman and her son as they are living in India. The High Court also directed that the concerned state and central agencies ensure that there is no hindrance in their subsequent return to Thailand.
