New Delhi: The top court on Saturday has issued an order for a DNA test of an 84-year-old man imprisoned on rape charges. The court has given this order to find out the father of the child born after the rape of a minor girl. The said accused raped a 14-year-old minor girl, after which the victim gave birth to a child on 5 July.
Kapil Sibal, the lawyer for the accused in the case, told the court that the man is 84 years old and is unable to perform biologically sexual activities, especially given the many diseases he is suffering from. The police report said that the accused is fully capable of sexual intercourse and his DNA has been taken for profiling and crosschecking with the child.
Counsel for the accused insisted that DNA test should be done as soon as possible as the accused has been imprisoned since May 12, his health is also deteriorating. The Kolkata High Court on 5 June, rejected the bail plea of the accused in view of the seriousness of the crime. The accused has claimed that the 14-year-old girl and her family are tenants, and they were already having a dispute over payment of rent, due to which he has been falsely accused.
