New Delhi: The Supreme Court has dismissed public interest litigation (PIL) seeking the arrest of Yati Narsinghanand Saraswati and Jitendra Tyagi (former name Waseem Rizvi). The petition was filed by the Indian Muslim Shia Isna Ashari Jamaat. The petition had also sought a ban on the book 'Mohammed' written by Rizvi. The petitioner had also asked the apex court to restrain Yati Narsinghanand and Jitendra Tyagi from making commentary on topics related to Islam, Prophet Mohammad and religion. However, a bench of Chief Justice UU Lalit and SR Bhat refused to consider the plea.  

The court said such a petition was not maintainable under Article 32 of the Constitution. Questioning the demand for arrest, the Supreme Court said that if the criminal case under Article 32 and the action in the case of arrest of someone go ahead, then what will be the meaning of the decision given in the 'Lalita Kumari case.' The court also asked the petitioner whether he had lodged a police complaint in this regard. After these questions of the court, the petitioner said that the appeal for arrest should be withdrawn and appealed to the court to look into other demands. However, the court rejected the petition saying that the case was not fit for hearing under Article 32. The court has said in its order that the petitioners can move in this direction under other options. In this petition, Rizvi and Yati Narsinghanand were described as a threat to security and integrity, social harmony, peace and law and order situation.

Let me tell you that former chairman of Shia Waqf Board Wasim Rizvi (now Jitendra Tyagi) released his book 'Mohammad' from Yati Narsinghanand Saraswati. He had also filed a petition in the apex court to remove verses from the Quran. In the petition, 26 verses of the Quran were said to promote terrorism. However, the apex court rejected the plea and imposed a fine of Rs 50,000 on Rizvi. AIMIM chief Asaduddin Owaisi and other leaders of his party had filed a complaint against Rizvi in Hyderabad in November 2021 over the book 'Mohammed'. Owaisi had said in the complaint, "The book written in Hindi has used highly objectionable language against Islam and its followers.''
