Telecom Sector Overhaul: India Introduces Ambitious Telecommunications Bill

New Delhi: On Monday, the Lok Sabha introduced the draft Telecommunications Bill, 2023, signaling a significant move to replace the outdated Indian Telegraph Act that has governed the telecom sector for 138 years. A key provision in the new bill empowers the government to take control, manage, or suspend any or all telecommunication services or networks in the interest of national security. The bill also seeks to redefine the scope of telecommunications by including over-the-top (OTT) services, such as internet-based calling and messaging apps, with a primary focus on enhancing user safety.

Notably, the proposed legislation addresses concerns raised by industry players regarding the authority of the Telecom Regulatory Authority of India (Trai). Government officials clarified that issues related to Trai and OTT players had been resolved before the Cabinet granted approval in August. The bill also includes provisions to ease certain rules, such as the refund of fees for license surrender.

One noteworthy aspect of the new bill is that it grants the government the authority to waive entry fees, license fees, penalties, and more in the interest of consumers, market competition, the availability of telecom networks, and national security. This move is aimed at ensuring flexibility and adaptability in the dynamic telecom sector while upholding vital national interests.
