New Delhi: The Delhi High Court, while hearing a case, has made a big comment regarding the age of marriage of Muslim girls. The court has said that according to Islamic law (Shariah), even if the girl is below 18 years of age, she has the right to get married of her own free will without the consent of her maternal uncle. Justice Jasmeet Singh made this observation while hearing a petition filed by a Muslim couple. According to reports, the couple had married in March this year and fearing the family had filed a petition in the court seeking protection.

Actually, the girl's family members were against this marriage. They had also filed a case under section 363. Later, Section 375 of IPC and Section 6 of Pocso were also added to it. Whereas, the girl has told in her statement that her parents always used to harass her. She ran for the marriage of her own free will. According to the documents produced in the court, the girl's date of birth is August 2, 2006. That is, the age of the girl was 15 years 5 months at the time of marriage. Following a complaint from the family, she was brought back from her husband in April and underwent a medical checkup at Deen Dayal Hospital.

It has been found in the medical report that after the marriage, physical relations were also established between the girl and her husband and now the girl is about to become a mother. The couple had petitioned the court to avoid the family, after which the court, while hearing the case, said that, according to Islamic law, if the girl has become mature, she can marry her husband without the consent of her mother and father. Can live separately. Even if she is less than 18 years or a minor at that time.

The court also found that in this case, he cannot impose the section of POSCO, as it is not a case of sexual violence. In this, the couple married after falling in love and then established physical relations. The court also found that the girl had legally married her husband and wanted to live with each other. The court said 'If the petitioners are separated, then it will be a trauma for the petitioners and their future child. The object of the state government is to protect the petitioner. If the petitioner has solemnized the marriage and is happy, then no one can separate her by entering into her personal life.' Along with this, the court asked the girl to live comfortably with her husband and directed for the safety of the couple.
