New Delhi: All India Muslim Personal Law Board i.e. AIMPLB has approached the Supreme Court against the provision of immediate punishment against triple talaq. The petition filed by AIMPLB and Kamal Farooqui said that this law is wrongly affecting the life and personal liberty of Muslims. Kamal Farooqui said that the Muslim Women (Protection of Marriage Rights) Act-2019 passed in Parliament is unconstitutional.

As it violates Articles 14, 15, 20, 21, 25 and 26 of the Constitution. Speaking of Tripel Talaq will be considered a crime due to this law. The petitioners stated that this law makes arbitrary, unwarranted and wrongly terming triple talaq a crime. This violates Articles 25 and 26 of the Constitution. This violates the privacy of a citizen. Under the new law, any person related to the wife can give information about divorce-e-dissolution without the consent of the husband or wife.

It also includes relatives related to the wife's blood relatives and marriage. Through this law, a lot of internal things related to marriage also become public. Therefore, it also damages the rights of reputation and privacy. The petition states that the last was passed by the Center on 31 July. Through this law, a husband who gives three immediate divorces will be entitled to imprisonment for three years.

The Muslim Women (Protection of Marriage Rights) Act, 2019 makes the divorce-e-biddat or any other form of divorce in which the Muslim husband immediately divorces, null and void. This law makes the termination of three divorces illegal by speaking, writing, SMS or WhatsApp or any other electronic means.
