New Delhi: What is the need for an elected government in Delhi, when all the decisions regarding administration are taken on the orders of the central government? The Constitutional Bench of the Supreme Court made this comment on Thursday (January 12) during the ongoing hearing on the division of powers between the Center versus the Delhi government. A bench headed by Chief Justice (CJI) DY Chandrachud is currently hearing the division of powers between the departments of the Central and Delhi governments. At the same time, responding to the court's remarks, Solicitor General Tushar Mehta said that the central government has administrative control over the bureaucrats. However, they work for and report to the respective departments of the Delhi government.

On this, CJI Chandrachud said that such an interpretation makes the strange situation understandable. He said that suppose an officer is not doing his job properly. But, the right of his appointment, transfer, posting, etc. is with the Central Government only, so how will the Delhi Government take action against that officer? Can't she shift that officer? Can't she get another officer in his place? On this, the Central Government replied that there is a different procedure for taking action in such cases.

The central government said in the court that when this happens, the Delhi government or its concerned ministry writes a letter to the Lieutenant Governor (LG). That letter is sent by the LG to the concerned department of the Central Government, which takes action. Tushar Mehta said that LG also has the role of an administrator in Delhi. He said that it is very necessary for the central government to have administrative control in Delhi. The reason for this is that the capital is a sensitive place on many important issues including terrorism. The administration in Delhi should be run keeping national concerns in mind. Along with this, the control of the center is also necessary for better coordination with the neighboring states.
