Patna judge seeks transfer over fear of 'fundamentalists'

Patna: The order to demolish the 4-storey 'Waqf Bhawan' being constructed near the northern part of the new Patna High Court building was passed in the High Court recently with a judgment of 4:1. One such case came to light in 2005 when a judge who passed an order to stop the use of loudspeakers in a mosque nearby had to be transferred from Bihar due to strong opposition from some radical Muslims.

The then Judge, Justice Rs Garg had expressed displeasure over the use of loudspeakers during the court proceedings at a mosque attached to the High Court in Patna and asked District Collector Sudhir Kumar and SSP NH Khan to ensure that the court proceedings are not disrupted due to the life of the mosque. Justice Garg had then said that the azan given from the loudspeaker hampers his hearing. He had said that the killing of loudspeakers installed on the mosque was a violation of the directions given by the Patna High Court. Justice Garg had then said, "The members of the Mosque Management Committee consider themselves privileged because they are close to power and are presumptuous of violating court orders. The court will not spare anyone who disobeys its orders.''

A special bench of Justices Ashwin Kumar Singh, Vikas Jain, Ahsanuddin Amanullah, Rajendra Kumar Mishra and Chakradhari Sharan Singh had heard the 'Wakf Bhawan' case near the High Court building in Patna. In the hearing of the case, four bench judges ruled in favour of removing the construction constructed with the High Court, while Ahsanuddin Amanullah had expressed his disagreement in the matter and termed the construction as just against the rules but refused to consider it illegal.
