New Delhi: The skirmish between the central government and the judiciary continues over the appointment of judges. The central government is constantly raising questions on the system that a judge's son will become a judge, or a judge's favorite will become a judge and is appealing to improve this system. Dissatisfied with the current collegium system for the appointment of judges, Union Law Minister Kiren Rijiju has also written a letter to the Chief Justice of India (CJI) DY Chandrachud in this regard. In such a situation, a debate has started on whether, like politics, familyism prevails in the judiciary as well, due to which good judges do not get opportunities. This question is also arising because it is the Supreme Court collegium itself that sends names to the Central Government to select judges.

Pairing of Judiciary and Relatives:-

The first Chief Justice of India was Sir Harilal Jekisundas Kaniya (HJ Kaniya). His tenure lasted from 26 January 1950 to 6 November 1951. About 40 years later, HJ Kania's nephew Madhukar Hiralal Kania (MH Kania) also became the Chief Justice of India. The tenure of the 23rd CJI, MH Kania, was from 13 December 1991 to 17 November 1992. Another uncle-nephew pair is the 21st and 45th Chief Justices. Justice Ranganath Mishra was the 21st Chief Justice of the country. His tenure was from 26 September 1990 to 24 November 1991. After 27 years, Justice Deepak Mishra, nephew of Justice Ranganath Mishra, was the 45th Chief Justice of India from August 28, 2017, to October 2, 2018. 

Let us inform you that, at present, the 50th Chief Justice of the country is Dhananjay Yashwant Chandrachud (DY Chandrachud). Justice Chandrachud became the CJI on November 9, 2022. His term ends on November 10, 2024. However, interestingly, DY Chandrachud's father Justice Yashwant Vishnu Chandrachud (YV Chandrachud) was also the Chief Justice of India. He was the 16th CJI. His tenure was from February 22, 1978, to July 11, 1985. This is the longest tenure of any CJI so far.

The tenure of the 19th Chief Justice of India, ES Venkataramaiah, was from June 19, 1989, to December 17, 1989. Venkataramaiah was on this post for just 181 days. After which Justice BV Nagarathna, daughter of Justice ES Venkataramaiah, is currently a senior judge in the Supreme Court. Justice Nagarathna may become the Chief Justice of the country for a month in the year 2027. If this happens then she will be the first woman CJI of India.

Wherein, Justice BP Sinha and Justice BP Singh were grandfather-grandson. Justice BP Sinha was the sixth Chief Justice of India. At the same time, Justice BP Singh was working as a justice in the apex court between December 2001 and July 2007. Apart from this, Justice KS Hegde was the senior judge of the apex court. KS Hegde tendered his resignation on April 30, 1973, after a junior judge was made the CJI. After this, he was also the Speaker of the Lok Sabha. Later KS Hegde's son Santosh Hegde also became a judge in the apex court. Santosh Hegde was a judge in the Supreme Court from January 1999 to June 2005.

Not only this, KK Mathew, father of Justice KM Joseph, a senior judge of the apex court, was also a judge of the Supreme Court. His tenure was from 1971-76. Justice Sanjiv Khanna's father was a judge of the Delhi High Court and his uncle Justice HR Khanna was a judge of the apex court. The fathers of Justices PS Narasimha and Sudhanshu Dhulia have also been judges of the High Courts.
