Impeachment motion against CJI: YSRCP not signed yet

New Delhi [India], Mar 28 (NT): The grand old party Congress and some other Opposition parties have signed a draft proposal to move an impeachment motion against Chief Justice of India Dipak Misra.

 However, the YSR Congress Party (YSRCP) MP M. Rajamohan Reddy on Wednesday said that his party has not received any proposal for moving an impeachment motion against Chief Justice of India (CJI) Dipak Misra.

This move came a day after the opposition bid decided to draft an impeachment motion against the CJI in relation to the matters raised by four Supreme Court judges( Justice J Chelameswar, Justice Ranjan Gogoi, Justice Madan Bhimarao Lokur, Justice Kurian Joseph) in a press conference on January 11, 2018.

Reddy, also added that the decision on the same would be taken once they would make contact with the opposition leaders.

"Nobody has contacted us till now for this; we have only seen media reports. In any case, our leadership will decide if such a thing comes up," Reddy told ANI in an interview.

The impeachment development move follows West Bengal Chief Minister Mamata Banerjee's meet with senior lawyer Prashant Bhushan on Tuesday to talk about a possible impeachment motion against the CJI Deepak Misra.

Worth mentioning here, to present an impeachment motion, the proposal should have a support of 50 members if it is tabled in the Rajya Sabha, and similarly 100 members in Lok Sabha. The motion can be submitted in either House and the Speaker may admit or discard such a proposal. In case the proposal is established, the Speaker forms a three-member commission to investigate the charges laid against the CJI.

 In this case CJI Misra, if found guilty the House can take up the matter and then The President finally addresses the Parliament and passes the impeachment order.

Earlier in January, Justices Jasti Chelameswar, Ranjan Gogoi, M.B. Lokur and Kurien Joseph in a joint press conference claimed that CJI Misra was assigning important cases in an arbitrary manner to junior judges, ignoring them, who are the senior judges of the top court.
