Lucknow: National Security Act (NSA) has been ordered to be removed from Dr Kafeel Khan of Gorakhpur. The Allahabad High Court, while issuing an order to remove the NSA, has directed to release Dr Kafeel Khan immediately. The imposition of NSA on Dr Kafeel was challenged in the court. A habeas corpus petition was filed on behalf of Dr Kafeel by his mother Nuzhat Parveen.

Dr Kafeel was taken action under the NSA for making inflammatory speeches regarding the Citizenship Amendment Act (CAA) and National Citizenship Register (NRC). District Magistrate Aligarh had imposed NSA on Dr Kafeel alleging him of spreading hatred. Kafeel Khan has been imprisoned in Mathura jail for the past several months. While pronouncing the verdict, the Allahabad High Court said that "The order passed on February 13, 2020, on behalf of the Aligarh District Magistrate (imposition of NSA) is illegal. The extension of the period of detention of Kafeel Khan is also illegal". The order to release Dr Kafeel Khan is issued immediately.

The custody of Dr Kafeel Khan was recently extended for 3 months. Kafeel Khan has been imprisoned in Mathura jail under the NSA for the past nearly 6 months. Under Section 3 (2) of the National Security Act (Rasuka) 1980, on 13 February 2020, Kafeel Khan was imprisoned on the orders of the Aligarh District Magistrate.
