Mumbai: Attorney General KK Venugopal on Tuesday appealed to the Supreme Court to overturn the Bombay High Court's decision that scan to scan contact would be considered a sexual assault. On this, the Attorney General said that this is an absurd argument and that anyone can commit and escape by wearing gloves.

In fact, in January this year, the Nagpur bench of Bombay HC had said that if there is no scan to scan contact between the accused and the child/child, then a law cannot be imposed POCSO. Saying this, the high court had decided to acquit the accused. However, on January 27, the apex court stayed the acquittal of the accused. During a hearing on a petition on the definition of sexual assault under the POCSO Act on Tuesday, Attorney General KK Venugopal said, 'If a person molests a woman wearing surgical gloves tomorrow, he will not be punished for sexual assault as per the controversial high court verdict for the crime.'

"In the last one year, 43,000 cases have been registered under Pocso, and under this definition, anyone wearing gloves can sexually assault and avoid punishment," he explained. He termed the Bombay High Court's decision as a "humiliating example."
