New BCCI constitution approved by SC, Sourav-Jay Shah to continue for 3 more years

New Delhi: The Supreme Court has given a big relief to president Sourav Ganguly and secretary Jay Shah while giving a green signal to the amendment made by the Board of Control for Cricket in India (BCCI) to its constitution. Now the way for his next term has been cleared. The BCCI had amended its constitution to relax the tenure and cooling period of officers.

Following the apex court's decision, the office-bearers can now have a maximum tenure of 12 years in the BCCI and any state association at a time. Along with this, there will be a cooling-off period of three years if he continues in the BCCI for two consecutive terms i.e. 6 years. In the case of BCCI vs Bihar Cricket Association, the court also said that any amendment to the constitution of the board will not be effective without the permission of the court. Let us tell you that there was a change in the constitution of BCCI for Sourav Ganguly to continue as the President. After this, this petition was filed about three years ago.

The new BCCI constitution came into force in 2018. It had a rule that any officer who has completed his two terms at the state or BCCI level will have to complete a cooling-off period of three years. Under this rule, on completion of six years, that person will automatically be completely out of the election race. The BCCI had filed a petition in the court seeking changes in these rules and complete repeal of the cooling-off period. It also requested the court to amend its constitution and give more power to the secretary so that the board does not have to come to the court again and again.  

In fact, the BCCI also said in the Supreme Court that two consecutive terms of its officers should be allowed. The BCCI has argued that state cricket associations also have a cooling-off period of three years. This causes problems in their promotion to BCCI. On this, the apex court has said in its decision that instead of one term, a cooling-off period can be given after two terms.
