Delhi High Court directs AIIMS to set up a medical board to investigate woman's fetus disorder

New Delhi: The Delhi High Court has directed the Medical Superintendent of AIIMS to constitute a board to ascertain the status of a 25-week pregnant woman. A serious discrepancy has occurred in the woman's fetus, due to which she has requested permission for an abortion.

A vacation bench of Justice Vibhu Bakhru has instructed the Medical Superintendent of the All India Institute of Medical Sciences (AIIMS) to submit a report by January 4, regarding the medical condition of the fetus. The High Court was hearing a petition by a woman. The woman has sought permission to conceive for 25 weeks due to fetal disorder. Advocate Sneha Mukherjee, appearing for the woman, has informed the High Court that the fetus will not survive because both her kidneys have not developed yet.

The court said that considering the facts, the Superintendent of AIIMS is ordered to constitute a medical board to examine the woman. This board will submit its report on the condition of the fetus and its chances of survival. Under section 3 of the Medical Termination of Pregnancy Act, pregnancy after 20 weeks is not allowed. The petition stated that the woman was made aware of the disorder in the fetus in Ultra Sonography on the 25th week. She does not want to give birth to an underdeveloped child due to the child's disorder, so she should be legally allowed to conceive.
