Delhi riot: Big relief to Tahir Hussain, High Court put stay on this order

New Delhi: The order of the removal of Tahir Hussain, the main accused in the riots in East Delhi, has been stayed by the Delhi High Court. Hussain filed a petition against this in the High Court. Hearing this, the Delhi High Court today stayed the decision of the East Delhi Municipal Corporation (EDMC) to declare Tahir Hussain as a councillor of the municipal body.

Membership of AAP Councilor Tahir Hussain, accused of violence in north-east Delhi, was abolished in the East Delhi Municipal Corporation house. This step was taken when three consecutive sittings of the House were absent. Tahir had been absent from the House meetings in January, February and later in June and July without any information prior to the violence in February. Sub-section two of section 35 of the Municipal Corporation Act provides that if a member of the corporation stays absent for three consecutive meetings of the house without prior notice, the membership of the concerned councillor of the house can be cancelled.

Under this provision, the Municipal Corporation Secretary moved the motion in the House. After discussion, the motion was unanimously passed by the House. According to the proposal, Tahir Hussain was representing Ward No. 59E. This seat was vacant.
