New Delhi: The person who provided a pistol to Shahrukh Pathan during the Delhi riots has been acquitted by a Delhi court. The court argued that no one saw the accused giving the pistol. Police are saying that both the accused have confessed to their crime. However, this type of confession cannot be considered legally valid. The other evidence collected by the police is also not sufficient to convict the accused.

According to the police, during the Delhi riots on 6 December 2019, accused Babu Wasim had given a pistol and cartridges to Shahrukh Pathan. Shahrukh tried to kill the police sergeant by firing at him. Police had registered a case against Wasim under the 25 Arms Act. The court of Additional Sessions Judge Amitabh Rawat acquitted him in this case, but ordered to file a chargesheet against him in the case of evading the police. Wasim had changed his hideout several times to escape from the police. Finally, on April 13 last year, he was caught by the police.

During the Delhi riots, the photo of Shahrukh pointing a pistol toward the sergeant went viral. A case was registered against him at the Jafrabad police station. Along with the 25 Arms Act, he was accused of inciting riots and obstructing the duty of a government servant. According to the police report, on the night of December 6, 2019, Shahrukh made several calls to Wasim. Finally, the location of both was found at the same place.

Additional Sessions Judge Amitabh Rawat said that both were at the same place. The two also talked on the phone four times. However, there is no evidence on record to suggest that Wasim provided the pistol to Shahrukh. Police say that Wasim has accepted in his statement that he had given the pistol to Pathan. However, the court finds that the confessional statement is not correct in law. The police theory is based on imagination. Let us tell you that 53 people were killed and more than 200 were injured in the Delhi riots. While hearing the Delhi riots, the court had said that the aim of the mob was only to kill and harm Hindus. That's why this riot is also called an anti-Hindu riot.
