'Encroachment on govt land will be removed', SC refuses to hear against the order

New Delhi: The Supreme Court has categorically refused to hear the petition challenging the notification to remove encroachments in the Union Territory of Jammu and Kashmir by January 31. The top court has said that if we give you relief, it will affect the whole of Jammu and Kashmir.

After this stand of the Supreme Court, the petitioner has withdrawn his petition from the court. The Jammu and Kashmir Administration said during the hearing that the petitioner is claiming ownership under the Roshni Act. But, this Roshni Act has already been abolished. This is not a case of small land ownership. They have the ownership of large land. The petitioner said that we have paid the full amount at the rate of commercial land, and our right of ownership is secure with us.

Earlier, the top court had refused to stay the circular issued by the Jammu and Kashmir government, directing the deputy commissioners to remove encroachments on government land in the state under the Roshni Act by January 31, 2023. However, the bench of Justice MR Shah and Justice CT Ravikumar did not pass any written order.
