Mumbai: After the separation of husband and wife, a sessions court in Mumbai has given a big decision regarding alimony. In this regard, the trial court had ordered that Hamla earns more than her former husband, so she will not get alimony. The sessions court has also upheld this order. The court said the woman's income was Rs 4 lakh more than that of her former husband.
After the trial court's order, the woman filed a petition in the sessions court. The court said that it is true that alimony should also be given to the earning woman, but in this case it is very important to look at the circumstances. If the woman is earning more than her ex-husband then she does not need alimony. At the same time, if the husband is earning more, then it is necessary to look at the circumstances. Justice CV Patil said, "The decision taken by the magistrate court in this case is correct. The woman had filed a case of domestic violence against her in-laws in 2021. She said that after the birth of the child, she was forcibly sent to her parents' house."
Subsequently, a court had asked the husband to pay a limony of Rs 10,000 per month so that the child could be brought up. The woman had also told the court that her husband was undergoing treatment. His family thought he couldn't become a father. The woman had alleged that when she became pregnant, her in-laws started suspecting her. Allegations were made about the character. The judge also said that under the Domestic Violence Act, it was necessary to pass an interim order at the earliest. "There is no need to go into too much detail in this matter. It is right to give allowance for the child but not for the woman. The woman wanted a separate alimony for the child and separate alimony for herself, but the court rejected the plea for a separate alimony. The husband says that he is not the father of the child. "
