Kochi: The wife of Judge Kalam Pasha of Palakkad District Sessions Court in Kerala has approached the Kerala High Court to register a complaint against him for granting triple talaq. Kalam Pasha's wife has also alleged that she was also threatened by Kalam Pasha's brother and retired judge B Kamal Pasha. According to the woman, Kalam threatened her that if she refused to divorce him, she would have to face dire consequences.
The complainant woman stated that Kalam Pasha gave her triple talaq on March 1, 2018. He also sent a letter in this regard on the same day. But later, he sent her another letter saying that there was a typing mistake and the original date was March 1, 2017. The woman alleged that it was an attempt to avoid legal procedures, which led to mention of a date before the law was enacted against the triple talaq.
According to the Supreme Court, to register a case against a judge, the permission of the Chief Justice concerned is necessary. Prior to two years, a preliminary inquiry was conducted after the High Court took cognizance of the case. On July 30, 2019, the Parliament of India passed a law against triple talaq and declared it a punishable offence. It was also implemented from August 1 the same year.
