New Delhi: The Supreme Court has turned down a petition against the Supreme Court collegium not providing details of its meeting held on December 12, 2018, under the Right to Information (RTI). The details of the collegium meeting were not made public. After this, its details were sought under RTI. The top court said that the collegium discusses in its meeting and does not proceed until a decision is taken. The court made strong observations while rejecting the demand for disclosure of details under the RTI Act.

The Supreme Court said that discussions were held in the Collegium meeting on December 12, 2018, as well, but no decision could be taken. If any decision is taken in the collegium meeting, its information is given on the website of the Supreme Court. However, decisions are not taken in every meeting of the collegium and the meeting gets postponed after discussion. The Supreme Court dismissed the appeal giving these statements. The Supreme Court of the country said that whatever is discussed in the collegium shall not be in the public domain. Only the final judgment is required to be uploaded on the website of the Supreme Court. We do not wish to comment on media articles.

The court said that the collegium is a multi-member body, whose provisional decision cannot be made public. The top court said it could not believe the media reports and the interview of a former member of the collegium and did not want to comment on the statements of the former judge. The Collegium, in a resolution passed on January 10, 2019, mentioned that in its meeting held on December 12, 2018, only consultations were held on some names, but no final decision was taken.
